Important Notice
Welcome to using the VIP Lifetime Member Buyout Service (hereinafter referred to as the "VIP Lifetime Member Buyout Service" or "this Service") provided by Shanxi TreeNest Network Technology Co., Ltd. (hereinafter referred to as "TreeNest Technology") for its application, TreeNest Browser. To protect your rights and interests, please read all contents of this Service Agreement (hereinafter referred to as "this Agreement") carefully before using this Service, especially the sections in bold.
Unless you have read and accepted all the terms of this Agreement, you are not authorized to use this Service. Your purchase or use of this Service indicates that you have reached an agreement with TreeNest Technology and voluntarily accept all contents of this Agreement.
If you are under 18 years of age, please use this Service under the accompaniment of your legal guardian or with their consent; the exercise and performance of your rights and obligations under this Agreement by a minor shall be deemed as having obtained the recognition of the legal guardian. This Agreement is legally binding on you and your legal guardian.
Article 1 Acceptance and Revision of the Service Agreement
1.1 This Agreement includes the main body of the Agreement and various rules already published or potentially published/updated in the future by TreeNest Technology. All rules are an integral part of this Agreement and have the same legal effect as the main body of the Agreement. In case of any conflict between the main body of this Agreement and the aforementioned rules, the main body of this Agreement shall prevail. Unless otherwise explicitly stated, your use of the Lifetime Membership Buyout Service is bound by this Agreement.
1.2 Due to the characteristics of the internet industry, if this Agreement and related service rules need to be revised due to business development needs, TreeNest Technology will announce the changes on the download page of its application, TreeNest Browser. You can check the latest version of the agreement terms there. After TreeNest Technology modifies the aforementioned terms, if you do not accept the modified terms, you can choose to terminate the use of the Lifetime Membership Buyout Service. Your continued use of this Service will be deemed as acceptance of the modified agreement.
Article 2 Service Description
This Service is a type of buyout service period launched based on your demand for permanent buyout use, under the premise that you have activated the TreeNest Browser VIP Lifetime Membership and any future newly added/adjusted paid services. The corresponding billing cycle allows permanent use starting from the date of activating the VIP Lifetime Membership service. Except for reasons such as app removal from the store or inability to operate due to force majeure, fees paid for the Lifetime Membership are non-refundable and non-exchangeable. The final interpretation right belongs to TreeNest Technology.
Article 3 Rules for Using VIP Lifetime Membership
3.1 After purchasing the VIP Lifetime Membership through TreeNest Browser, it can be used permanently under the same Apple ID account from the date of activation. The purchase can be restored at any time after uninstalling the app.
3.2 The Service provided to you by TreeNest Technology is limited to your use within the apps developed by TreeNest Technology, such as TreeNest Browser. Any use of paid services by illegal means such as malicious cracking to avoid payment constitutes a violation of this Agreement. All legal consequences arising therefrom shall be borne by the actor, and TreeNest Technology will pursue the legal responsibility of the actor according to law.
Article 4 Service Suspension, Interruption, and Termination
4.1 Unless otherwise notified or announced by TreeNest Technology, this Service will remain valid long-term. This Agreement takes effect after you choose to accept or use this Service and terminates when you terminate this Service or cancel your paid service eligibility.
4.2 In any of the following circumstances, TreeNest Technology has the right to immediately terminate the service to you without bearing any responsibility to you or any third party:
(1) If an effective legal document from a national administrative or judicial authority confirms that you have engaged in illegal activities or torts, or if TreeNest Technology, based on its own judgment, believes that your behavior is suspected of violating the content of this Agreement or the usage rules published from time to time for software developed by TreeNest Technology including TreeNest Browser, or is suspected of violating the provisions of laws and regulations;
(2) Your behavior interferes with the normal operation of any part or function of TreeNest Browser;
(3) TreeNest Technology believes that there is a significant risk in providing this Service to you.
4.3 TreeNest Technology may choose to suspend, interrupt, or terminate this Service for reasons such as its own business decisions. If such a situation occurs, TreeNest Technology will notify you by means of an announcement.
4.4 If subsequent versions introduce purchase models related to automatic renewal, and if you wish to cancel automatic renewal, you can cancel automatic renewal 24 hours before the end of the next subscription period by the following methods:
Apple ID Purchase
l iOS12 and above: Open the "App Store" on your Apple iOS device --> Click the Apple account avatar in the upper right corner --> Enter "Account" --> Click "Subscriptions" --> Select TreeNest Browser and cancel the subscription;
l Below iOS12: Open "Settings" on your iPhone --> Enter "iTunes Store & App Store" --> Click "Apple ID", select "View Apple ID", enter the "Account Settings" page, click "Subscriptions", select TreeNest Browser, and cancel the subscription.
Article 5 Other Provisions
5.1 The interpretation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China, excluding the application of conflict of laws provisions. If any dispute arises regarding the signing or performance of this Agreement, both parties shall strive to resolve it through friendly negotiation; if negotiation fails, either party may file a lawsuit with the competent people's court in the defendant's domicile.
5.2 TreeNest Technology's failure to exercise, delay in exercising, or incomplete exercise of any right under this Agreement or according to legal provisions shall not be deemed as a waiver of that right, nor shall it affect TreeNest Technology's future exercise of that right.
